Terms & Conditions

Tickets to this Event are issued on behalf of the Organiser Hupstate Circus and are subject to the following terms and conditions:

Ticket Policy

Individual ticket holders:

Tickets cannot be refunded after purchase, all sales are final*.

Discounts are only available at the time of purchase and are not retroactive.

*We value the health and wellbeing of our audiences and know that there may be extenuating circumstances. Please contact us if you have individualized needs related to our ticket policy and we will do our best to accommodate you.

In the event of a rescheduled show:

If the Event is rescheduled or moved, the Organizer will give you the options of either retaining or exchanging your tickets for the new date/location. If the Event is canceled, you may be offered the option to transfer your ticket to a future event or a refund on your tickets. Please note that any Booking Fees and/or Transaction Fees are not refundable in these circumstances.

If the Event is rescheduled, changed, moved or canceled the Organiser cannot be held responsible for any resulting costs you may incur for travel, accommodation and other related goods, services or compensation.

The Organizer reserves the right to alter or vary the content or timing of any part of the Event in circumstances beyond its reasonable control without any obligation to make any refunds or exchange tickets.

Hupstate Circus Inc values a healthy community, and our priority is to bring our festival to life for the safety of everyone. Our Covid safety plan will be updated as restrictions change.

COVID-19 and contagious disease conditions of entry 

Event access is restricted, limiting anyone who has:

• Flu-like symptoms or is contagious in any way.

• Is subject to a self-quarantine or self-isolation period.

To enter the event, attendees must use the covid safe measures that are current at the time of the festival, which will be posted at the venue and noted on your ticketing page. Hupstate Circus Festival’s baseline policy is masks optional unless otherwise requested by the performing artists.

All ticket holders are responsible for self assessing the above. Event management has the right to ask patrons who confirm they have COVID-19 or other contagious disease symptoms to leave the event.

FORCE MAJURE & COVID-19 CANCELLATION 

In the event that the festival is canceled due to a Public Health Order or other government instruction, natural disaster or any event beyond our reasonable control, we will refund 90% of your ticket price. 10% of your ticket price will be retained to cover administration and production costs.

We appreciate your understanding as a non-for-profit that relies on community support, volunteer workers, sponsorship, and grant funding to hold our event/festival.


Seating and Show Information

Seating is general admission so plan to be at the door early enough to claim your favorite seats!

Every effort will be made to admit latecomers at a suitable break in theaters, workshops or performances.

Visitors are not permitted to bring animals to the Event with the exception of service animals who are individually trained to do work or perform tasks for an individual with a Disability. Emotional support animals are not permitted.

For the well being of all parties, onsite staff may ask the following questions (as permitted by the ADA) if you bring an animal to an indoor venue:

  • Is the animal a service animal required because of a disability?

  • What work or task has the animal been trained to perform?

Accessibility varies by venue and can be found here. Our staff is ready to assist those with accessibility, sensory, or mobility concerns to enjoy the show. If you or any members of your party need to request special accommodations please email us at info@hupstatecircus.org at least 24 hours prior to arrival to provide the info we need to plan for your arrival. 

Do you need space for a wheelchair or mobility device?  

(All of our venues are accessible but general admission, so knowing this in advance helps us best support our audience).


Photo, Sound, Video, and Media Passes

Video and sound recordings are not permitted in theatrical and performance areas of the Event unless written permission is provided by the Organizer.

Media passes are granted at the discretion of the media manager - please contact Avi@hupstatecircus.org at least two weeks prior to the Event.

Visitors may be filmed, photographed or sound recorded for broadcast, publication, or security purposes whilst at the Event by the Organizer and our trusted sponsors and partners.

Weather

If all or any of the Event is planned to take place outdoors it will take place regardless of weather conditions (unless deemed unsafe by the safety officer). We strongly advise that you come dressed appropriately for an outdoor Event.

Please check Event details, timings and parking charges prior to traveling as these may be subject to change.

Please check your route prior to traveling to ensure you arrive on time. The Organiser is not responsible for any delays due to travel disruptions.

The Organiser does not accept any responsibility for any loss or damage to personal property brought to the Event.
